Statutory Procedures For The Pfer Of Registered Trademarks

(1) according to the twenty-fifth provision of the trademark law, the pferor and assignee of a registered trademark shall jointly apply to the trademark office.

(2) the pferor and the pferee shall deliver a copy of the application for the assignment of the registered trademark to the Trademark Office, and the application procedure for the assignment of the registered trademark shall be handled by the pferee and the pferor shall give assistance.

(3) the Trademark Office shall examine the application for the assignment of a registered trademark, and, if qualified, approve it, issue it to the pferee, and make a public announcement.

The pfer of registered trademarks shall take effect from the date of approval and pfer by the trademark office.

The pfer of registered trademarks should be noted: 1, the pferee must conform to the second provision of the implementation rules of the trademark law, that is, enterprises, institutions, social organizations, individual businesses, individual partnerships and foreigners or foreign enterprises that conform to the ninth provision of the trademark law.

(2) when a registered trademark is pferred, if the Assignor has the same or similar trademark in the same or similar commodity, it must be pferred with the pferred trademark.

This is to safeguard the distinguishing function of trademarks, prevent misunderstandings or confusion, and ensure the normal circulation of commodities.

(3) the pferee shall, in accordance with the provisions of article eleventh of the trademark law, provide the documents issued by the health administration department or the documents approved by the state tobacco regulatory authority for approval.
